Marital Status Changes:

When are royalty checks paid?

Your monthly check for both oil and gas will be mailed to you by the end of each month.  The minimum amount that must be accumulated before a check is issued is $25.00, however, in December accounts with accumulated funds of more than $1.00 will be released.

Are there options to receiving my royalty payments?

Requests to receive payments via wire transfer, electronic transfer, checks regardless of the amount or when the account balance reaches a designated number, must be made in writing to the following address:

Why didn’t I receive a check this month?

The reasons will vary. If there is less than $25.00 in your account, a check will not automatically be issued. Also, we could have a bad or unknown address on file for you or your interest could be in suspense. Payments are made only for those months when oil and gas is sold from properties in which you have an interest. If there are no sales from these properties, then Nortex will not issue a check for that recording period. Adjustments to earlier payments can result in a negative account balance. In such an event, the negative balance will be carried forward until the account returns to a positive balance exceeding $25.00. At that time a check will again be issued. What do I do if my check is lost, stolen or becomes outdated?

If a check is lost, stolen or becomes outdated, please call the Hotline (1-888-766-6819or send an email for instructions on how to get a check voided and reissued.

How can a check that is three months old or older be cashed?

The expiration date on our checks is 90 days from issuance. After 90 days, please call the Hotline (1-888-766-6819or send an email for instructions on having a check reissued.

What should I do if I do not receive my royalty check?

Due to potential postal delays, a check may arrive a few days late. If your check is more than two weeks late, please contact the Hotline (1-888-766-6819) so that we can research the issue.

Why does the amount of my royalty payment change from month to month?

Changing market conditions can cause price fluctuations, while mechanical problems, operational problems and routine maintenance can temporarily affect production, all of which can affect royalty payments. Check amounts may vary from month to month depending on production volumes, price of product, marketing arrangements, changes in tax laws or any adjustments that may be required. If you have reason to believe an error has been made, please contact our Hotline (1-888-766-6819).

Why are adjustments made to my payment?

Nortex strives to disburse revenue in accordance with an owner’s lease agreement and state statutes. If an error or discrepancy is discovered, a correction will be made and adjustments may result. For instance, Nortex may be given inaccurate production figures or pricing from a transporter. An adjustment would be required to correct this matter.

Why does my payment differ from my family members?

Payments may differ from other family members for several reasons, including, non-resident tax laws, rounding of decimal interest, and the conveyance or assignment of a partial interest. For more information, contact our Hotline (1-888-766-6819) via phone or email.

What should I do when the owner of record passes away?

The process of effectuating transfers as a result of death varies by state and depends, in part, on whether or not the decedent died testate (with a will) or intestate (without a will). Please click here for additional information or contact the Hotline (1-888-766-6819) via phone or email for the appropriate instructions for the state in which the property is located.  Please note that payments may be temporarily suspended pending receipt of appropriate transfer documents.

How do I transfer my ownership to someone else?

Property can be transferred by Assignment, Special Warranty Deed, General Warranty Deed or Quit-Claim Deed.  Please consult your attorney when attempting to effectuate a legal transfer.  Please note that the acceptance by Nortex of any legal instrument does not mean that Nortex has reviewed the instrument to determine if such instrument is legally sufficient to effectuate the desired transfer.  Please have the appropriate instruments recorded in the real property records of the county in which the property is located and mail a recorded copy to Nortex (copies will not be returned) at the following address:

In your correspondence to Nortex, provide the social security number of the new payee, the new payee’s address and daytime telephone number. Also, please note the effective date in which the transfer should become effective.

How do I locate the County Clerk’s Office associated with my property?

How do I put my interest into a Trust?

Prepare or have prepared a Memorandum of Trust and a conveyance document from the current owner of record into the trust.  Please consult your attorney when attempting to effectuate this legal transfer.  Please note that the acceptance by Nortex of any legal instrument does not mean that Nortex has reviewed the instrument to determine if such instrument is legally sufficient to effectuate the desired transfer.  Please have the appropriate instruments recorded in the real property records of the county in which the property is located.  If the instrument must be recorded, mail a recorded copy to Nortex and if the instrument does not need to be recorded, mail a fully executed copy to Nortex (copies will not be returned) at the following address:

In your correspondence to Nortex, please provide the tax identification number of the trust and its telephone number and address.

How do I notify Nortex of a change in trustee?

Provide that portion of the trust document that determines who is successor trustee as well as the duties and powers of the trustee and the circumstances leading to the replacement of the trustee.  In addition, please let us know if we need to change the address of the trust in our records.  Have the appropriate instruments recorded in the real property records of the county in which the property is located and mail a recorded copy to Nortex (copies will not be returned) at the following address:

How do I add my spouse to my account?

What type of annual statement will I receive and when will I receive it?

Owners will receive a 1099 statement for payment received in the prior year. 1099′s are required by law to be mailed out by January 31st.

What is a division order?

A division order is a contract of sale to the purchaser of oil or gas.  The order directs the purchaser to make payment for the value of the oil or gas purchased in the proportions set out in the division order.

What is a transfer order?

A transfer order is a direction to the purchaser of oil or gas under a division order to pay another person a share in the oil or gas produced.  If subsequent to the execution of a division order, a person or entity entitled to a share of the proceeds of the sale disposes of some or all of his interest in the proceeds, the transfer order is the means by which notification of such disposition is given to the applicable purchaser.  Transfer orders generally contain fewer terms, make reference to the original division order and are signed by both the transferor and transferee.

Where can I research unclaimed funds?

All states have escheat or abandoned property laws that require the reporting of funds held for its Citizens or those who have deceased leaving no heirs. To reclaim these funds, you must contact the office of the applicable state.

When are royalty payments suspended?

Royalty payments may be suspended for a variety of reasons, including:
- Unexpected Division Order and/or IRS W-9 Form
- Unsatisfied title requirements
- In process transfer of property
- Death of owner
- Lack of contact information
- Ongoing or prior litigation

How do I clear the title to my mineral rights?
